Terms of service

Overview

These Terms of Service (“Terms”) govern your use of the BYBOWU website and set out the general principles we follow when you ask us for work. BYBOWU is run by Roman, based in Phoenix, Arizona. For client projects we sign a separate written agreement (a proposal, statement of work or contract), and where it differs from these Terms, the agreement applies.

Using the website

• You may use the site for lawful purposes only.
• You agree not to disrupt, scrape or reverse engineer the site or its systems.
• Content on this site is general information and may change without notice. The free tools are provided as they are.

Briefs, quotes and estimates

• Sending a brief, filling in a form or writing to us does not create a client relationship.
• We reply to a brief with a written quote within 1 business day. It becomes a fixed price when you sign the agreement; before that, nothing is binding for either side.
• For custom products, the quote may be for a one-week scoping sprint ($1,900, credited toward the build); the fixed price for the build follows the sprint. If you don’t go ahead, the sprint’s feature list, user flows and screen sketches are yours to keep.
• We may decline projects that are not a fit or that carry legal, security or reputational risk.

Client work and deliverables

For paid work, the signed agreement defines scope, deliverables, milestones, acceptance, fees, ownership of the work and support. Unless it says otherwise:

• The fixed price changes only if you add to the scope, and we quote the addition in writing first.
• Work is delivered in stages, and staying on schedule depends on timely feedback and content from you.
• Third-party services (domains, payment processors, app stores, paid plugins and similar) are subject to their own terms and fees.
• We may reuse general know-how and techniques that are not specific to your project.
• Once the project is paid in full, you own the code, design and content we create for it. On the monthly Launch plan, ownership passes with the 12th payment or early payment of all remaining installments. Third-party components (open-source libraries, fonts, plugins) stay under their own licenses.
• You approve the homepage design, or the agreed key screens for an app, before the build continues. Two rounds of design changes are included. For a one-time build, you can stop before approving that design and owe only the 30% build deposit. Delivered sprint planning work is a separate purchase. Monthly Launch has the no-payment design checkpoint described below.
• Bugs in our work—errors against the agreed delivered scope—are fixed at no charge for 30 days after launch, and for as long as we host the project on a Hosting or Care plan. New features, changed requirements and new third-party or platform requirements are separate scope, quoted before work starts.

Payments

For a one-time build, the usual schedule is 30% when the agreement is signed, 40% at the agreed build milestone and 30% on completion. Your quote names the milestone and shows any sprint credit, so that fee is not charged twice. After design approval, cancellation and payment for completed milestones follow the signed scope.

Monthly Launch

Monthly Launch is $0 down and 12 payments of $149 ($1,788 total), including first-year hosting. Before you approve the homepage design, you can stop and owe nothing; two design-revision rounds are included. Approving the design commits you to the 12 payments. The first payment is due when the site goes live, followed by 11 monthly payments.

If you cancel after design approval, the unpaid installments remain due. You can pay the remaining balance early to receive ownership and all completed work. There is no separate cancellation fee. The quote and design-approval step make this commitment clear before you accept it. Monthly Launch does not include monthly content edits and is separate from a Care plan.

Package scope

Launch covers up to five public pages, a contact form, click-to-call and Google Maps, with AI-drafted text finished for your approval. You supply the logo, photos, service details and feedback; its seven-day delivery window starts when the required content is received. Launch does not include a content editor, store, customer accounts or custom booking logic. Those are separate scope.

Business Plus includes the Business website with a booking-tool connection or blog, a second-language version and one standard integration with an existing supported tool. The quote names the tools and approved translations. Shopify quotes name the catalog size, data entry or migration, theme and payment/shipping setup. Provider subscriptions and fees are separate.

Hosting and care plans

Hosting is $79 a month or $790 for a year: hosting on our server, SSL, daily backups, uptime monitoring, security and software updates, and free fixes for bugs in our work. Changes are quoted per task. Care plans add 1, 3 or 6 hours of changes each month for $149, $349 or $649. These plans are optional; Launch includes the first year of hosting. Shopify stores run on Shopify, whose subscription is separate from any BYBOWU care work.

Cancel a monthly Hosting or Care plan before its next renewal to stop further payments; the already-paid period remains available. Annual Hosting renews only with your agreement, with the renewal price confirmed in writing before payment. If you cancel annual Hosting, we refund unused full prepaid months at $790 divided by 12 per month, rounded to cents. The current partial month is not refunded; there is no extra cancellation fee.

Once ownership has transferred, you can move to another host or developer. We hand over the code and a database copy at no charge. Ending a Hosting or Care plan does not cancel any remaining monthly Launch installments.

Results we can’t promise

We aim to deliver high-quality work, but we do not guarantee specific search rankings, revenue or business results, because they depend on things outside our control: your market, competition, budget, product, timing and how the business is run.

Limitation of liability

To the maximum extent permitted by law, BYBOWU is not liable for indirect, incidental, consequential or special damages arising out of or related to your use of the website. For client work, liability is defined in the signed agreement.

Governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules.
